1. About this policy
This Privacy Policy explains how Assembly Property Group Pty Ltd (ABN 90 702 764 270) (Assembly Property Group, we, us or our) collects, holds, uses and discloses personal information. We handle personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs).
We provide strata management, building management, concierge and property consulting services in New South Wales. This policy applies to personal information we handle through our website, our services and our dealings with owners, occupiers, owners corporations, contractors, suppliers, job applicants and other people we deal with.

You can deal with us anonymously or using a pseudonym for general enquiries. For most of our services, however, we need to identify you.
3. How we collect personal information
Wherever practical, we collect personal information directly from you – for example, when you contact us, complete a form, attend a meeting, use our owner or resident portal, or speak with our building or concierge staff.
We also collect personal information from third parties, including:
a previous strata managing agent, the owners corporation, its strata committee or building manager when we are appointed;
real estate agents, conveyancers, solicitors and other parties to a sale or lease;
contractors, suppliers, insurers and service providers to the buildings we manage;
public sources such as the NSW Land Registry Services title and strata plan records; and
referees and recruitment agencies, for job applicants.
If we receive personal information we did not ask for, we will decide whether we could have lawfully collected it. If not, we will destroy or de-identify it where lawful and reasonable to do so.
4. Why we collect, use and disclose personal information
We collect, use and disclose personal information to provide our services and run our business, including to:
carry out our functions as strata managing agent under our agency agreements and the Strata Schemes Management Act 2015 (NSW), including keeping the strata roll and records, issuing notices, convening meetings and managing levies;

Automated decisions
We do not use computer programs to make decisions about individuals that could reasonably be expected to significantly affect their rights or interests. Our systems may automate routine tasks, such as generating levy notices and arrears reminders, but our staff make decisions about individuals. If this changes, we will update this policy.
5. Who we disclose personal information to
Depending on the circumstances, we may disclose personal information to:
owners corporations, strata committees and other owners, as required or permitted by strata legislation (for example, strata roll inspections and meeting records);
building managers, concierge staff, contractors, tradespeople and suppliers engaged for a building;
insurers, insurance brokers, loss assessors, valuers, auditors and other professional advisers;
debt recovery agents and lawyers, for unpaid levies and legal matters;
government bodies, courts, tribunals and regulators, including NSW Fair Trading and the NSW Civil and Administrative Tribunal;
our IT, cloud software, document storage, payment and communications providers; and
an incoming strata managing agent, if our appointment ends.
We do not sell personal information.
We do not disclose personal information to recipients outside Australia.
6. Our website and direct marketing
When you visit our website, we and our website and analytics providers may collect technical information such as your IP address, browser type, device information, pages visited and the date and time of your visit. We use cookies and similar technologies to operate the website, understand how it is used and improve it.

If you submit an enquiry or contact form, we collect the information you provide and use it to respond to you.
Our website may link to third-party websites. We are not responsible for their privacy practices, and we encourage you to read their privacy policies.
Direct marketing
We may send you information about our services if you have agreed to receive it or would reasonably expect to. Every marketing message will include a simple way to opt out, and you can also contact us at any time to opt out. We comply with the Spam Act 2003 (Cth). We do not use levy or strata roll information for marketing.
7. Security, retention, access and correction
Security
We hold personal information in secure cloud-based systems and, where necessary, in hard copy at our office or in buildings we manage. We take reasonable technical and organisational steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. These include access controls, multi-factor authentication, staff training and confidentiality obligations on our staff and service providers.
If a data breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme.
Retention
We keep personal information for as long as we need it for our services and to meet legal record-keeping requirements, including under strata and property agency legislation. When it is no longer needed, we take reasonable steps to destroy or de-identify it. Records belonging to an owners corporation are handed over to it, or to its new managing agent, when our appointment ends.
Access and correction
You can ask for access to the personal information we hold about you, or ask us to correct it, by contacting us (see section 8). We will respond within a reasonable time, usually 30 days. We may need to verify your identity first.
We will not charge you for making a request, but may charge a reasonable fee for providing access. If we refuse access or correction, we will tell you why in writing and how to complain. Access to the strata roll and owners corporation records is also governed by the Strata Schemes Management Act 2015 (NSW).
8. Complaints, contact and changes
